Eastvale Fire Station 31 Recognized in Firehouse Magazine

Eastvale – In the November 2017 edition of Firehouse Magazine, Eastvale Fire Station No. 31 received a notable recognition in the Career Category 2 Fire Design section designated for stations built less than 15,000 square feet in size.

The 4th annual 2017 Station Design Awards showcased 43 fire and emergency services facilities in North America designed and constructed to meet the needs and responsibilities of its personnel and the community that it serves.

Fire Station No. 31 is a 6,004-sq.-ft. facility built by the City of Eastvale for the Riverside County Fire Department (RCFD). The corner site in the southern part of the city was built in a predominantly residential area. The station is designed to accommodate five firefighters in an individual dormitory setting. The station a two-bay and single-deep apparatus bay, administrative offices, a kitchen with a dining area, an onsite gym as well as a plethora of support spaces required for a facility of this type. Some of the other state of the art features include visitor parking covered firefighter parking, a separate storage building as well as an above-ground fuel station. The design of the station was heavily influenced by the how narrow the available space of the construction site. The apparatus bays are located as far from the corner as possible. The balance of the station follows the side street frontage, allowing for the drive-through requirements of the RCFD. The station was design was well thought out with the sole intention of the architectural style of the area. Sloped roof forms are used in conjunction with parapet areas designed to screen mechanical equipment. The station is scheduled to receive a LEED Silver rating based on the sustainable goals of the City of Eastvale.

Eastvale – Michele Nissen, Eastvale City Manager, received the Boy Scouts of America Distinguished Citizens Award for the ‘Temescal District’ Inland Empire last month. The other two recipients included Kathy Azevedo, former Mayor of Norco, and Jim Pauley, member of the Corona Rotary Club.

The Distinguished Citizens Award is given to those who have been exemplary models of service for community youth; this individual is one who has demonstrated leadership in business, or government, and who “lives by the Scout Oath and Law.” As there are many individuals who contribute time and effort to the Boy Scouts and/or local government and business, the award is not easily come by in any district.

Ms. Nissen was informed of her selection prior to the Temescal Boy Scouts dinner. A picture of her and her fellow award winners could be seen at the dinner itself, as they posed happily together with their respective trophies for the Distinguished Citizen Award on September 27, 2017.

“I didn’t do anything that was specifically about supporting Boy Scouts operations, projects or fundraising,” stated Nissen humbly. “What they are achieving…they are doing all on their own with hard work and support of the Eastvale Community as a whole.” Still, as City Manager, Nissen obviously has something to do with how the Boy Scouts have flourished in and around the Eastvale area.

Nissen continued, “As for the Distinguished Citizen Award, I was very surprised and I wasn’t sure I had done anything above and beyond to warrant such recognition. Needless to say, I was very proud and honored to be recognized.” The City Manager has lived in Eastvale since October 2001 and has since then focused on service for the community. She was appointed to City Manager of Eastvale in May of 2015.

Nissen’s contributions obviously impressed Boy Scout leadership. The Boy Scouts have 2,157 youth members, with over 500 adult volunteers delivering the program, in the Norco, Corona, Eastvale, Chino, and Chino Hills communities. Collectively, over 10,000 hours of community service projects that positively impact the communities in a variety of ways have been gathered just this year.

Each year, approximately 85 Scouts earn the coveted “Eagle Rank.” This is a difficult rank to obtain involving many hours dedicated toward a single, community-impacting project. Currently, more than 45 Chartered Partners, including local churches, service clubs, and community organizations, deliver local packs, troops, teams, and crews.

The Boy Scouts is an organization that lives and abides by actions of integrity. By their high standards, Michele Nissen fulfilled the “Scout Oath” they proudly uphold: “On my honor I will do my best/ To my duty to God and my country/ And to obey the Scout Law;/ To help other people at all times;/ To keep myself physically strong, mentally awake, and morally straight.”

INCIDENT: GRAND THEFT AND CONSPIRACY

WHEN: 10/16/2017

WHERE: 1200 block of Hamner Ave., City of Norco

On October 16, 2017, at approximately 2:00 p.m., deputies from the Norco Sheriff’s Office responded to a theft at a business, located in the 1200 block of Hamner Avenue, in the city of Norco.

Three suspects entered the business, took merchandise, and exited without paying. Officers arrived at the location and contacted a suspect (later identified as Melargo Bobo, age 20 of Lancaster).  Two other suspects (later identified as Oshaunice Holderness, age 25 of Lancaster, and Angelica Bobo, age 25 of Lancaster) were also located after they attempted to drive away from the location. Deputies located additional evidence inside of the vehicle linking them to an additional theft that occurred at a retail business located in the 12400 block of Limonite, in the city of Eastvale.

All three suspects were arrested and booked into the Robert Presley Detention Center, located in the city of Riverside for grand theft and conspiracy. Anyone with information regarding this investigation is encouraged to contact Deputy Bloomer or Deputy Robertson from the Norco Sheriff’s Office at (951) 270-5673.

 

INCIDENT: POSSESSION OF STOLEN PROPERTY

WHEN: 10/18/2017

WHERE: 13000 block of Running Deer Circle, Eastvale

DETAILS: On Wednesday, October 18, 2017, about 9:06 AM, a resident called to report a vehicle theft of his dirt bike motorcycle. The victim informed officers that his dirt bike motorcycle was stolen from the inside of his garage.  The victim posted a picture of the stolen dirt bike, via social media. Numerous residents of Eastvale reported both on social media and through calls for service with dispatch as to seeing two individuals riding on the reported stolen dirt bike.

About 7:00 PM, the victim was notified, via social media, that his stolen dirt bike was placed at a corner near his residence. Deputies assigned to the city of Eastvale conducted further investigation regarding the pictures that were posted on social media. The suspects were identified as eighteen-year oldDestin J-Brent and a fifteen-year old juvenile both of Eastvale.

On Thursday, October 19, 2017, Destin J-Brent was booked into Robert Presley Detention Center for possession of stolen property and the juvenile was booked into Juvenile Hall for possession of stolen property.

The Eastvale Police Department would like to thank the vigilante citizens of the community of Eastvale. The leads generated by the citizens of Eastvale helped solve this crime. INCIDENT: MAJOR INCIDENT- TRAFFIC COLLISION INVESTIGATION

WHEN: 10/21/2017

WHERE: Country Village Rd and Oak Leaf Way, Jurupa Valley

DETAILS: On Saturday, October 21, 2017, at 2:25 a.m., officers assigned to the Jurupa Valley Police Department responded to the area of Country Village Rd. and Oak Leaf Way, Jurupa Valley, regarding a major-injury traffic collision.  The preliminary investigation revealed a vehicle traveling northbound on Country Village Rd., drifted into oncoming traffic, colliding head-on with a vehicle traveling southbound on Country Village Rd.  The occupants of both vehicles were transported to local area hospitals for serious injuries sustained during the collision. This investigation is ongoing, but alcohol and/or drug impairment appears to be a factor in this collision.

The Jurupa Valley Police Department’s Traffic Collision Reconstruction Team responded to the scene to conduct this investigation.  This investigation is ongoing and we are asking anyone with additional information to contact Deputy Petersen at the Jurupa Valley Station at 951-955-2600.

PUBLIC ANNOUNCEMENT: ILLEGAL MARIJUANA DISPENSARY

WHEN: 10/25/2017

WHERE: Riverside County

DETAILS: The Riverside County Sheriff’s Department has experienced an increase in the number of criminal investigations involving the illegal sales of marijuana at storefront locations known as dispensaries. The Sheriff’s Department began identifying an increase in the number of non-medical marijuana dispensaries following the passage of Prop 64, in November 2016.

In the State of California, sales of non-medical marijuana are illegal and all sales of marijuana for profit is prohibited under Prop 215. California law has only DECRIMININALIZED (Not Legalized) the sales of marijuana to seriously ill individuals who have a physician’s recommendation. This means that person(s) who sale, cultivate and/or possesses marijuana for their personal medical needs or the medical needs of a person they are a caregiver for will have a legal defense for selling, cultivating or possessing marijuana, as long as they do not exceed the amount of marijuana reasonably necessary for their medical condition. Under Prop 215, a medical marijuana recommendation from a doctor does not exempt a person from an investigation or prosecution.

On October 25, 2017, the Riverside County Sheriff’s Department’s Marijuana Enforcement Team served a search warrant for illegal sales of marijuana at a local dispensary in the City of Jurupa Valley. Following a criminal investigation, and pursuant to the search warrant, several items of marijuana product were seized as evidence. Once the investigation is completed, the case will be referred to the District Attorney’s Office for criminal prosecution.

The Riverside Sheriff’s Department would like to remind the public that sales of non-medical marijuana is in violation of State and Federal law. Those found in violation of illegal sales of marijuana are subject to arrest and prosecution. The City of Jurupa Valley would also like to remind residents that all sales of marijuana are strictly prohibited in the city.

 

INCIDENT: HOMICIDE- PUBLIC ASSISTANCE REQUESTED

WHEN: 8/26/2017

WHERE: 6900 block of Adele Ln., Jurupa Valley

DETAILS: UPDATE: 10/27/2017: Central Homicide Unit is asking for the public’s assistance with this homicide investigation and encourage anyone with any information regarding this vehicle of interest to call.

ORIGINAL INCIDENT: On Friday, August 25, 2017, at about 9:48 PM, deputies from the Jurupa Valley Station responded to a call of an assault with a deadly weapon occurring in the 6900 block of Adele Lane, Jurupa Valley. Upon arrival deputies located a Hispanic male suffering from gunshot injuries. The male was transported to a local hospital where he was pronounced deceased.

Investigators from the Jurupa Valley Station and Central Homicide Unit responded and assumed the investigation. The investigation is ongoing. No suspects have been arrested.

99 Cent Store Construction Halted

Eastvale – Construction of the 99 cent store on the northwest corner of Hamner Avenue at “A” street has come to a screeching halt several months ago.

Eric Norris, the Planning Director for the City of Eastvale said, “Now that their structure is partially constructed, they need to have a water system installed onsite so that the Fire Department could put out a fire if one were to occur. The problem is, there isn’t an onsite water system installed (so, no fire hydrants). “Someone at 99-Cent forgot to have those plans checked by the Fire Department, so they are going through that process”.

Several months ago a stop work order was filed by Tim Steeson says Fire Marshall, Sandie Hastings. The retailer had begun combustible construction on site without any on site fire hydrants, said the Fire Marshall. They are supposed to be installing the underground utilities soon, when that happens they will be able to continue the construction with the combustible materials.

The plans still need to be approved and the water system installed with the fire hydrants, then and only then will they be allowed to re-start the construction. Residents may notice that there is framing and wood on site but that has been there since before the stop work order was issued.

This project has been met with mixed emotions by the residents of Eastvale, some may have hoped that maybe they decided to pull out but that just isn’t the case.

It would be interesting to know how much money the retailer is losing on a daily basis for a mistake of this magnitude, which was unavailable at Press time. This is just another instance of the City of Eastvale doing their due diligence and the retailer is making a costly mistake by not checking plans with the Fire Marshall. Whether you disagree with the construction or not of this retailer the management of the City of Eastvale was once again on point.

Can You Stop A Barking Dog?

Last week, a woman in Eastvale posted her frustration on the city Facebook page regarding a very loud dog her neighbors have.

What to do about neighboring barking dogs – particularly when they consistently disturb the peace of surrounding residents – can be a relevant question for many.

If a person calls Animal Control, this will not do much to alleviate the immediacy of the barking noises. Animal Control will mail a form to the complaining resident, one that stipulates that the dog is disturbing the peace. That form, in turn, will be sent to the address of the dog’s owner, after which the reporting resident will have to attend court to finally issue a citation. This process can take quite a while.

Those affected by the barking of a neighbor’s dog may take the old-fashioned approach of simply asking the dog owner/neighbor to control their dog’s barking, perhaps through a bark collar. This may or may not be effective depending of the type and receptivity of the person approached. If so confronted, the dog owner may also voice a concern of humane animal treatment, since dog collars are suspected on some level of incurring pain to the animal.

One resident responded to the Facebook complaint by suggesting a “Sonic Bird House Bark Control” sustainable outdoors. This essentially is a bark collar but in a birdhouse form, one that can be placed outdoors, in one’s own yard, without breaking down because of weather. If a person uses this, he or she is essentially controlling the barking of a neighbor’s dog without that neighbor’s permission through ultrasonic sound waves.

Back in 2009, Riverside County – Eastvale and Norco included – approved an anti-nuisance ordinance aimed at silencing noisy dogs by increasing fines for owners up to $500 and including remedies such as obedience training. This process, however, does go through Animal Services and through the Court process, as described above.  The law is meant to expedite the process by allowing an administrative hearing officer, sometimes a practicing attorney in arbitration, to hear the complaints and make the decisions quickly, but this is not always the case.

In Chino Hills, residents are instructed to contact the Inland Valley Humane Society. In Chino, citizens must call Animal Control, and if after hours, a police officer will be dispatched, but only if the caller reveals his or her identity. Generally, simply a warning is issued initially. The same process is outlined for Diamond Bar residents. Thus, there doesn’t seem to be any one expedient way to handle barking dogs in one’s neighborhood, and, while there is some sort of process, it will not be quickly remedied through the government.

Costco Inks Deal To Open

Eastvale – The last hurdle has been cleared for the long awaited Costco project to move forward without any further negotiations. The city of Eastvale agreed to increase the $2.5 million to $4.5 million in future sales tax to be paid to the centers developer of the Goodman Commerce Center in November of 2016. One month after Eastvale officials agreed to the sales tax refund for the developer Costco has signed a deal to be the project’s retail anchor.

Costco will occupy 10 of the 40 acres set aside for retail in the 205-acre project.  The original pact for the $2.5 million in sales tax from the project was to help pay for street and other infrastructure improvements but the increase in the sales tax was needed to attract the likes of a big box retailer the size of Costco. City officials are very excited and grateful to be getting a Costco this will be a big deal for the city on a couple of different levels, first there is the projected $1.1 million in sales tax annually. Also when companies like Costco commit to be the anchor of the shopping center it all but guarantees other well respected, high revenue retailers will be interested in bringing their businesses to the city. Total infrastructure costs — including street improvements, sidewalks, and water, sewer and utility poles — are expected to be $36 million, according reports by the city. The City Council only agreed to the proposal as long as the lease with Costco was signed by September 30 and the store open by the end of 2018. The City also said they are going to do everything in their power to make it happen even sooner.

INCIDENT: ANNIVERSARY OF UNSOLVED FATAL HIT AND RUN ACCIDENT

WHEN: 9/6/2017

WHERE: Limonite Avenue between Lucretia Avenue and Wineville Avenue, Jurupa Valley

 

ORIGINAL INCIDIENT: On Tuesday, September 6, 2016, at 2:06 a.m., deputies from the Jurupa Valley Police Department responded to the area of Limonite Avenue and Lucretia Avenue, in reference to a reported traffic collision.  Deputies arrived on scene within minutes, along with personnel from Cal Fire, and located a deceased male in the roadway. The investigation revealed the decedent, whom is a resident of Jurupa Valley, was riding his bicycle westbound on Limonite Avenue when he was struck from behind by a vehicle.  The vehicle did not stop and fled the scene.  Limonite Avenue between Lucretia Avenue and Wineville Avenue, was closed for seven hours due to the investigation.  The name of the deceased male is being withheld until the next of kin can be notified. Anyone with information about this incident is urged to contact Deputy Ditfurth of the Jurupa Valley Station Traffic Team at (951) 955-2600.

 

UPDATE: One year later, this fatal hit-and-run traffic collision remains unsolved. In the early morning hours, of Tuesday, September 6, 2016, Forrest Holmes, a resident of Jurupa Valley, was riding his bicycle westbound on Limonite Avenue when a vehicle struck him from behind then immediately fled the scene. As part of their investigation, the Jurupa Valley Traffic Team obtained video surveillance from a nearby store. The video showed Holmes riding his bicycle westbound on Limonite Avenue, then seconds later, a white, or light colored sedan is seen driving at a high rate of speed, also westbound Limonite Avenue in the same lane of traffic as Holmes was riding his bicycle in.  To date, the involved vehicle and driver have not been identified, and there are no new leads in this case.  The Jurupa Valley Traffic Team is hoping to solve this case with the help from the public. They are asking for someone to come forward with a credible tip, or to admit they were the driver of the vehicle that night. INCIDENT: INDOOR MARIJUANA CULTIVATION/ THEFT OF UTILITIES

WHEN: 9/6/2017

WHERE: 1200 Block of Columbia, Eastvale

DETAILS: On September 6, 2017, at 3:00 PM, patrol deputies assigned to the city of Eastvale were summoned to a residence in the 12000 block of Columbia, Eastvale, reference a possible possession of stolen property investigation.  While at the residence, they located evidence of an illegal, indoor marijuana grow. The Eastvale Special Enforcement Team was notified and a search warrant was granted for the location. Members of the Jurupa Valley Station’s Special Enforcement Team, served the search warrant around 7:20 PM. Evidence of illegal marijuana cultivation along with an electrical bypass to steal electricity were located inside of the residence. There were no persons at the location during the investigation. Over 1600 marijuana plants were located inside the residence. The investigation is on-going. INCIDENT: AT RISK MISSING PERSON

WHEN: 9/6/2017

WHERE: 3700 Block of Quartz Canyon Rd., Jurupa Valley

DETAILS: On September 6, 2017, at 3:08 PM, deputies assigned to the city of Jurupa Valley Police Department were dispatched to the 3700 block of Quartz Canyon, regarding a missing person.  A case worker from the Good Samaritan Hospital in Bakersfield, CA reported 61-year-old Mario Garcia Sanchez had not arrived at his new care facility in Jurupa Valley.  Mr. Sanchez is described as a Hispanic male adult, 5’09” tall, thin build, with a salt and pepper buzzed haircut.  He was last seen wearing a black t-shirt, shorts, and black Nike flip flops.  Mr. Sanchez was seen walking in the area on video surveillance, but he never arrived at his destination.  Mr. Sanchez does have some medical issues and he may appear dazed and confused if located.

INCIDENT: SEXUAL BATTERY INVESTIGATION AND ARREST

WHEN: 9/12/2017

WHERE: 1200 Block of Hamner Ave., Norco

DETAILS: On Tuesday, September 12, 2017, at 3:52 p.m., deputies from the Norco Sheriff’s Office responded to a business in the 1200 block of Hamner Avenue, in the City of Norco. Upon arrival, deputies learned an adult male suspect had sexually assaulted two adult females and one juvenile. All three incidents occurred inside of the business, while the victims were shopping. The suspect was able to flee the location prior to the arrival of the deputies. Store security camera footage captured the suspect on video.  On Saturday, September 16, 2017, about 3:57 p.m., deputies were advised the suspect had returned to the business and left after being inside the store for several minutes. Deputies were able to develop investigative leads that led to the identification and location of the suspect. On Sunday, September 17, deputies contacted the suspect at his residence in the city of Eastvale. The suspect was identified as Miguel Muro, age 30. The suspect was subsequently arrested for several counts of sexual battery and booked at the Robert Presley Detention Center. The Norco Sheriff’s Office is concerned there may be additional victims who might have been assaulted by the same suspect. They are encouraged to contact Deputy Robertson of the Norco Sheriff’s Office at 270-5673. Citizens may also submit a tip using the Sheriff’s CrimeTips online form.

 

INCIDENT: WANTED GANG MEMBER IN POSSESSION OF FIREARM AND DRUGS

WHEN: 9/21/2017

WHERE: Dirt Field near 34th St. and Wallace St., Jurupa Valley

DETAILS: On September 21, 2017, about 1:45 PM, members of the Riverside County Sheriff Department’s Region 7 Gang Task Force contacted a Hispanic male adult living in an abandoned motorhome in a dirt field near 34th Street and Wallace Street in Jurupa Valley. Task Force officers recognized the male as 29 year-old Jurupa Valley resident Miguel Angel Aguilar. Task Force officers also recognized Aguilar as being a member of a criminal street gang. Aguilar was also being sought for an active PRCS or Post Release Community Supervision felony warrant and an additional felony warrant for vehicle theft.  Task Force officers conducted a probation search of the motorhome and located a loaded firearm and methamphetamine. Aguilar was arrested and later booked into the Robert Presley Detention Center for the following charges:

  • Felon in possession of a firearm
  • Felon in possession of drugs with a loaded firearm
  • Gang member in possession of a loaded and unregistered firearm
  • Felon in possession of ammunition
  • Under the influence of methamphetamine while armed
  • Two outstanding felony warrants

WHERE: 6400 Block of Emerald Downs, Eastvale

DETAILS: On September 21, 2017, at 4:00 PM, members of the Jurupa Valley Station’s Special Enforcement Team served a search warrant in the 6400 block of Emerald Downs in the city of Eastvale. Evidence of illegal marijuana cultivation along with an electrical bypass to steal electricity were located inside of the residence. The following suspects were arrested and booked into the Robert Presley Detention Center for cultivation of marijuana, possession of cocaine, theft of utilities and possession of an unregistered firearm:

  • Yong Heng Huang, 20-year-old resident of Eastvale
  • Jia Jun Li, 20-year-old resident of Eastvale
  • Jing Feng Ma, 20-year-old resident of Eastvale
  • Da Yi Xiong, 21-year-old resident of Pasadena

Mailbox Thefts Recur

Eastvale – Another cluster of Mailboxes have been broken into last week at the corner of Post and Lost Fort Place, and please alert residents about their mail being missing. But most mail thefts occur at night, so its recommended to pick up your mail every day after your courier has arrived, most likely by 5 pm.

A few months back, residents reported thefts off Spring and Nicole Court, on the side of Riverboat and King River, and up and down Tisdale. Many believe that the thefts had increased at that time because of expected tax returns. However, these thefts have been going on for a long time and they are not unique to Eastvale. Mail thefts have been reported in Corona, Norco, Chino and other surrounding areas.

But local Police and the US Postal Service are adamant about stopping these thefts from occurring.

“The United States Postal Inspection Service will continue to bring violators to justice to secure the integrity of the U.S. Mail,” said Postal Inspector in Charge, Robert Wemyss in a statement. “Protecting the ability to use the mail in a safe and secure manner is at the core of the Postal Inspection Service’s mission,” he added.

“Mail theft and other property crimes are a rising problem and trend in this region,” said Corona Police Department Chief of Police Michael Abel. “We take these matters seriously and truly appreciate the joint cooperation in this prosecution. It’s important that we hold suspects such as these accountable for their actions.”

Fall Into Some Fun At JCSD’s Annual Fall Festival Jurupa Valley

It is FALL FESTIVAL time again, this year it will kick-off on Saturday, October 7th, 2017. Jurupa Community Services District’s (JCSD) Parks and Recreation Department’s annual Fall Festival will be at Harada Heritage Park located at 13099 65th Street, Eastvale. Bring the whole family to join in the experience; there will be live music, dance performances and games. The Family Fun Zone, Hay Maze and a Pumpkin Patch are all day fun for the kids. It is back by popular demand the 2nd annual Red Wagon Parade if you own a red wagon decorate it and enter the contest. Admission is free on the day of the event the cost for the Family Fun Zone wristbands will be $5. There will be a large variety of food and merchandise to purchase from one of the many vendors that will be attending.

This year the City of Eastvale will be offering a free Bicycle Valet service in their continued efforts to develop a bicycle master plan and campaign to increase bicycle safety. Grab your helmet, hop on your bicycle, and pedal to the picnic!

Driveway Blockers Beware

In California, it is illegal to park a car in front of a driveway. According to California Vehicle Code § 22500, “A person shall not stop, park, or leave standing any vehicle… In front of a public or private driveway…” Anyone who decides to park in front of a driveway is subject to towing and citations.

This law may surprise a lot of people who believed that once they purchased a home they could do whatever they want with it. Contrary to popular belief, even in America we are not entitled to do whatever we want. You can park in front of your own driveway but just remember that the police can also write you a citation for doing it.  

 There are safety concerns for both the homeowner/renter as well and the local authorities. If a fire or other disaster were to happen near your home and you had to evacuate but a family member parked in front of your driveway you would lose all of the cars in that driveway. If there is a crime reported, it give the criminal another place to hide from the police when they come to investigate. It is also another obstacle the Fire department would have to negotiate during the chaos of putting out the fire.    

 The most effective solution would be to talk to your neighbors about the safety concerns for the community and the local authorities. If you have a neighborhood watch program in place, they could help you bring awareness to everybody that a citation can be issued for the offense.

  Although it might cause problems for the offending driver, residents are justified in reporting blocked driveways because it is simply against California Vehicle Code.

Non Profit Investigation: 88 Impact

Eastvale – In our investigative reporting series of local non-profits accountability, we have requested information and tax records for several area non-profits. Our response from 88 Impact Foundation, a local non profit who accepts donations from local residents, businesses, and government agencies, was “we are a private foundation and we do not have to disclose where our money goes out to.”

According to IRS.gov, this is incorrect. According to the IRS, you have the right to inspect and obtain a copy of a tax-exempt organization’s: Annual information returns (e.g., Form 990); Exempt status application materials; and Notice of status under Internal Revenue Code section 527(i).

“All we want to know is where the money goes. We are asking accountability,” said Michael Armijo, Editor of CityofEastvaleNews.com. “Nothing more, just where are you spending the money people and companies are donating. IF they are working with the city, and IF the city is spending money (labor, promotion, direct donations) on the foundation, then they are spending the taxpayers money. If the resident’s are donating, where is resident’s money going? That’s it.”

“As you have stated, 88 IMPACT Foundation is a 501(c)(3) private foundation, and as such is subject IRS regulations on all tax-exempt organizations and nonprofit organizations,” Anthony Chan, a freelance reporter, wrote in a letter to Hari Dihman, listed as the Principal in the 88 IMPACT Foundation.

The demand letter, which included the formality of content required under the Freedom Of Information Act, also stated; “According to the IRS, the following tax documents of all tax-exempt organizations must be available for public inspection and copying: Form 990, Form 990-EZ, Form 990-PF (Return of Private Foundation), Form 990-BL, Form 1065. 501(c)(3) Non-profit organizations must also provide Form 990-T for public inspection and copying.” The 88 IMPACT Foundation office personnel stated the opposite, that they were not required to comply and will not produce any documents regardless of IRS code.

According to their Facebook page; “The 88 iMPACT Foundation was built with the hopes of its founding family to create an impactful family legacy. As of April 22, 2014, the long talked about and anticipated 501(c)(3) Non-Profit 88 iMPACT Foundation has been filed & made active. 88 iMPACT Foundation will serve to further develop, support, educate, and create resources for all Small Business & Public Safety Agencies (i.e. Law Enforcement & Fire Fighters).” Their goal is to support the people that make our communities thrive economically & keep families, homes, and our businesses safe. “Under the California Public Records Act § 6250 et seq., I hereby request to inspect or obtain copies of public records of 88 IMPACT Foundation’s annual tax returns for 2014, 2015, and 2016 including: Form 990, Form 990-EZ, Form 990-PF, Form 990-BL, Form 1065, and Form 990-T,” the letter stated.

“The California Public Records Act requires a response within ten business days.  If access to the records I am requesting will take longer, please contact me with information about when I might expect copies or the ability to inspect the requested records,” Chan wrote. For exemption application materials, a community member is entitled to inspect or receive a copy of the organization’s exemption application (Form 1023, 1024, or other document required to be filed), any papers filed in support of the application and any determination letter issued by the IRS with respect to the application.

Nonprofits are required to file IRS Form 990 must allocate their annual expenses into three categories: 1.program expenses—expenses directly related to carrying out your nonprofit’s mission. 2. administrative expenses—expenses for your nonprofit’s overall operations and management—for example, costs of board of directors’ meetings, general legal services, accounting, insurance, office management, auditing, human resources, and other centralized services, and 3. fundraising expenses—including costs for publicizing and conducting fundraising campaigns, maintaining donor mailing lists, conducting special fundraising events, and any other activities that involve soliciting contributions. The IRS does not require that nonprofits spend any particular portion of their income on each category. It just wants nonprofits to report how they spend their money, according to nolo.com.

Failure to comply with public disclosure requirements can result in “a maximum penalty of $10,000 for each failure to provide a copy of an annual information return.”

Deputy Arrests Mira Loma Women for Identity Theft and Possession of a Controlled Substance

LOCATION: Britton Way / Mount Vernon Ave, city of Grand Terrace
SUSPECT(S): Shawna Hernandez, 27-year-old resident of Mira Loma
VICTIM(S): Confidential

SUMMARY: Deputy Joshua Gile was patrolling in the contract city of Grand Terrace. He conducted a vehicle check in the parking lot of the CVS Pharmacy. The vehicle’s tag was expired for over four years. The driver was contacted and identified as Shawna Hernandez. Hernandez had an outstanding warrant for her arrest and the vehicel was inventoried so it could be towed. Evidence of identity theft was discovered, such as other people’s mail, identifying information and access cards. Hernandez had burglary tools including pry bars, bolt cutters and other cutting tools used to facilitate the mail theft. Over an ounce of suspected methamphetamine and other drug paraphernalia was also found in the vehicle.

Hernandez was transported to Central Detention Center and booked for Identity Theft and sales of methamphetamine.

Non Profits Under Scrutiny

Eastvale – Local nonprofits have been under scrutiny and a lawsuit is being filed this week, which has opened a can of worms in compliance and liability. Some non-profits have reportedly experienced mishandlings of their finances, refusals to release tax records, and non-filings of IRS documents. A local Chamber is now being sued and other non profits are being requested to show their finances.

The local Chamber of Commerce is being sued this week as legal documents were completed and were ordered to be filed. The exact amount and the defendants, which are the board of directors for refusing to pay and respond, will be released once the suit has been filed in court. Releasing the names of the board members personally being sued prior to the filing would be considered “third party disclosure.” After the filing all information will be released as it will then become public record, and the lawsuit will lead to subpoenas of their finances.

“The board members are covered under their Directors and Officers (D&O) insurance,” said a local agency who insures non-profits. “They will be fine as long as they have the required insurance. If a non-profit is running without D&O, they can be assuming personal liability.”

Incorporated non-profits are usually not personally liable unless neglect or specific harm is inflicted. But other ways a nonprofit board member might be held liable include:

  • When a board member directly injures someone on purpose
  • When a board member guarantees a loan or other business debt for the nonprofit which then defaults on that loan or debt
  • When a board fails to make sure that the organization deposits payroll and property taxes or files mandated tax returns.
  • When a board member engages in fraudulent activities or does something illegal or just plain reckless that causes harm, or mixes up nonprofit and personal funds.

As long as the nonprofit is incorporated and board members do nothing “bad,” they should be fine, however, serving on the board of an unincorporated nonprofit.

Board members, in that case, are not protected the way they are in an incorporated nonprofit. These types of nonprofits are more common than you might think, so check the organization’s incorporation papers before agreeing to serve on a board. If you are already involved in an unincorporated nonprofit, consider the pros and cons of incorporating.  You and your fellow board members might sleep better if you took the steps to become incorporated.

Just to make sure that no legal actions slip through the cracks of incorporation law, most experts do recommend that nonprofits purchase Directors and Officer (D & O) liability insurance to protect against certain kinds of lawsuits and other types of litigation.

Local non profits are many, and all must have a 501 (c) (3) status granted by the IRS. A specific rule on nonprofits is that the debt follows the entity.

So who is qualified to be a nonprofit? According to the Internal Revenue Service (IRS), the Exempt Organizations Select Check (Publication 78 database) provides a partial listing of organizations that have been recognized by the IRS as eligible to receive tax-deductible contributions. For information on other organizations that have been recognized by the IRS as tax-exempt organizations, you may call IRS Customer Service at 877-829-5500. You can also contact them through any of the other methods described in Publication 557. This information can be found at IRS.gov. A contributor can also check an organization’s exemption letter, which states the Code section that describes the organization and whether contributions made to the organization are deductible.

The IRS sometimes recognizes a group of organizations as tax-exempt if they are affiliated with a central organization. This avoids the need for each of the organizations to apply for exemption individually. For more information, see Publication 4573Group Exemptions. According to the IRS, you have the right to inspect and obtain a copy of a tax-exempt organization’s:

Annual information returns (e.g., Form 990);

Exempt status application materials; and

Notice of status under Internal Revenue Code section 527(i),

In person at the organization’s principal office, or its regional or district offices, during regular business hours. Unrelated business income tax returns filed by organizations exempt under Code section 501(c)(3) are also available. You may also request copies of such materials in writing. The organization may charge a reasonable fee to cover copying and mailing costs.

You are entitled to inspect or receive a copy of any annual return for three years from the date the return was required to be filed (or, for an amended return, from the date it was filed). For more information, see the IRS’ frequently asked questions on public disclosure, the final regulations, or Disclosure Requirements at IRS.gov.

For exemption application materials, you are entitled to inspect or receive a copy of the organization’s exemption application (Form 1023, 1024, or other document required to be filed), any papers filed in support of the application and any determination letter issued by the IRS with respect to the application.

City Installs New Signs

Eastvale – The City of Eastvale will be installing 18 new signs at 9 different locations throughout Eastvale to prohibit “Commercial Trailer/Semi Trailer” and “Commercial Vehicles with Gross Vehicle Weight over 10,000lbs” from parking in the Residential District, under the Eastvale Municipal Code (EMC) 10.20.160.
The following locations are where the new signs will be posted:

Northbound Hamner Avenue between Citrus Street and Schleisman Road

Westbound Limonite Avenue, West of the I-15

Southbound Hamner Avenue, South of Bellgrave Avenue

Westbound of 68th Street, East of Tarah Street

Details:

On Saturday, July 23, about 9:00 a.m., deputies assigned to the Eastvale Police Department responded to a suicide at Orchard Park, located in the 5900 block of Festival Way, city of Eastvale. Upon arrival, deputies located a deceased male adult in the restroom area of the park. The investigation revealed the victim’s death appears to be a result of suicide.

The Riverside County Sheriff’s Coroner’s Bureau responded to the scene. This incident is still under investigation and the victim’s identity is being withheld until family is notified.
